Insight won the trial on the change of patronymic
March 17, 2015 — Insight public organization successfully completed important lawsuit. Odessa Administrative Court of Appeal made the resolution that has granted the appeal against the decision of the Court of First Instance. It‘s declared as illegal the decision of the Civil Registry Office to refuse changing patronymic of the applicant and agreed to oblige the Civil Registry Office to make the appropriate changes in applicant’s documents.
The Court of Appeal, despite the absence of permission to replace the patronymic at current legislation of Ukraine, took into account our arguments, which were supported by the practice of the ECHR and stated in the reasoning part “… a person has the right to change patronymic from … to …, although it is not directly provided by the legislation of Ukraine, since the refusal to change patronymic is not justified by public interest and does not violate the rights and freedoms of other citizens… ”
